What is Form I-9?

Form I-9 is used to verify the employment eligibility of a foreign worker. It's used by employers to confirm an employee's identity and ensure that they are legal to work in the US. The form was mandated by the Immigration Reform and Control Act of 1986, and it required that all employers verify their new workers' identities and employment eligibility.

An employee must complete Section 1 of the form when they start work, and the employer must fill out Section 2 within 3 days of the employee's start. It is the employer's responsibility to complete the forms properly and in a timely fashion, and the I-9 is not required for contractors or volunteers.

Employees have to present documents that both establish their identity and their legal eligibility to seek employment in the US. If the employee cannot read or write in English, the form may be prepared and signed by a translator in addition to the employee. In 2004, new laws allowed for the electronic completion and filing of the I-9 form, and certain documents must be reverified after they expire. The requirement doesn't apply to passports, or to Permanent Resident Cards or driver's licenses.
